in virginia for examination. the blast killed 8 people and destroyed numerous homes. a fifth person has been charged with posing as a victim of that pipeline explosion in order to get help. 51-year-old daniel stansbury of los altos has pled not guilty to seven charges including identity theft and falsely claiming aid. prosecutors say he went to a resource center for blast victims used a false name and said he lived in the crestmoor neighborhood. he then allegedly accepted more than $2,000 in gift cards. prosecutors also say he spent nine nights in hilton hotels paid for by pg&e. >>> the off again on again execution is now off again and it will be for some time. albert greenwood brown was scheduled to be put to death tonight. it would have been california's first execution in nearly five years. but the state supreme court denied a request by the state to begin using new procedures for lethal injection. now the state won't be able to execute brown until 2011 because california's supply of lethal injection drugs expires tomorrow. a new supply won't arrive until next year. >>> a bay area mom is

not guilty monday to murder charges stemming from the fatal shooting of a virginia man in downtown oakland two months ago. george huggins, 24, and his girlfriend, 33-year-old althea housley, are charged in connection with the death of 45- year-old jinghong kang, who was visiting the bay area for a job interview at google. he was killed at about 11:30 p.m. on july 18 during an apparent robbery as he walked with a friend to his car.oakland police said huggins and housley allegedly took $17 from him during the robbery.huggins and housley, are scheduled to return to alameda county superior court on nov. 1 for a pretrial hearing. >> are rumored sit still for muni would start today and last snow friday. meany says if there is it does start they will be able to take care of it. the union says that there is a flyer it is not sanctioned. they're working on a vandyke tobacco sales at pharmacies. they agreed to send this ordinance to the full board the legislation passed in 08 made this city the first one in the nation to overhaul have it pharmacies from selling tobacco. >> when alcohol alcohol foggy

woman executeded in the u.s. in five years was put to death late last night in virginia. 41-year-old theresa lewis died by injection at the greenville correctional center. she was convicted of hiring two men to shot her husband and son while they were sleeping so she could collect on a million dollar life insurance payout. she apologized it the moments before the execution. the first time they have executed a woman in a century. >> dugard expected back in court possibly to enter an insanity plea. phillip garrido's attorney may announce her client is mentally incompetent to stand trial. if the judge agrees to order a mental evaluation, it will put an immediate stop to the proceedings and could delay the case for years. both garrido and his wife nancy have pleaded not guilty. if garrido's found incompetent, he will be sent to a state medical facility until he is competent to stand trial. >> police at san jose city college have added extra patrols and warning women to be extra aware of their surroundings this morning. that follows an assault on a female student tuesday afternoon on
